The Ethics of Duty

After reading Chapter 6 – The Ethics of Duty, consider Professor Michael Sandel’s lecture on Immanual Kant’s moral philosophy.

 

German Enlightenment philosopher Immanel Kant (1724-1804) is one philosopher who did much to articulate an ethics of obligation.

Kant asked, among many other questions, what is it that can stop people from being evil? His answer, briefly, was reason. Only reason can provide the basis for an ethics of obligation. Kant’s thinking about such a rationally based ethics of obligation center on two notions: universality and respect for persons. Our text mentions the Kantian Categorical Imperatives:

Universality: Always act in such a way that you can will that the maxim behind your action can be willed as a universal law. (page 171)

Respect for persons: Act in such a way that you always treat humanity, whether in your own person or in the person of any other, never simply as a means, but always at the same time as an end. (page 173)

There is so much literature about Kant’s contributions to thought, but I suggest the following interview with a leading scholar on Kantian philosophy:

In the interview, concentrate on those elements that relate to the ethical questions.

Consider the following cases:

Immanuel Kant offers three examples that, to his mind, are not moral actions. In terms of Kantian moral philosophy, explain his reasoning.

Example 1: The shop-keeper at the self-owned cafe-bakery always gives the correct change to her customers and a small free cupcake, since being honest and giving a freebee are good for business.

Example 2: The fellow’s life is wretched; his wife left him for another man; his children never visit him; even his dog got up one day and left. The same man lost his job because of a layoff, and his kidneys were failing. He commits suicide, to shorten his miserable life.

Example 3: Sarah felt so good inside for helping the homeless lady at 11 West Division Street, in Chicago. Sarah felt so much better after giving the woman some good shoes, a thermal, water-proof quilt and fifty dollars. Sarah felt happy because she helped the homeless lady.

Were any of the people depicted in the examples truly moral, in terms of Kantian ethics? Apply Kantian moral thinking to one of the examples.

Rules for computer crime

When someone steals a piece of property, there is seldom a question whether a crime has been committed. But Randal Schwartz clearly did not think he did anything wrong, and many disinterested observers in the system-administration community at the time agreed. Similarly, while Aaron Swartz certainly knew he was bypassing something, many have claimed he had no reason to think what he was doing might be criminal.

Terry Childs may not have intended to be cooperative, but it seems clear he had no idea that he could end up in prison for four years. Jeremy Hammond certainly appears to have understood some might see his actions as criminal, but he felt what he was doing was a form of civil disobedience.

Certainly some judges and many prosecutors feel that they are quite capable of determining which computer crimes are “serious” and which are not. Should the rest of us trust their discretion? Crimes involving firearms are given hefty additional penalties; should the same be true of crimes involving a computer?

The CFAA criminalizes “unauthorized access”. This makes sense by analogy with physical property, but there is quite a bit of ambiguity as to what constitutes “unauthorized” access to a computer. Unauthorized use of physical property pretty much means stealing it; unauthorized use of a computer can cover a wide range of things.

For example, the CFAA, in theory, criminalizes creating a second Facebook account, or use of Google search by minors before the terms-of-service change on March 2013. These uses are explicitly “unauthorized” by the sites’ terms of service. When Bidders’ Edge got in trouble with E-Bay for collecting data about E-Bay auctions, it was because they had to create E-Bay accounts to get access to the system, and they used these accounts in ways contrary to the E-Bay terms of service. Using a workplace computer to check out Facebook, or even to check news headlines during lunch, is often “unauthorized” by your employer, and thus an unauthorized use of an employer-owned computer.

On the other hand, Lori Drew was acquitted of violating the MySpace terms of service, in a case in which Drew created a fake MySpace account that may have contributed to the suicide of Megan Meier.

Here is the central question: is a law against “unauthorized access” a good idea, or must there be some other standard as well, and, if so, what? Some possibilities are
the perpetrator caused actual harm (a problem with this approach is that harm is notoriously hard to evaluate)
the perpetrator acted with malicious intent, ie intent to cause harm (the government would have trouble proving that for most of our examples here)
???
Another way to summarize this question is simply “Is the CFAA too broad? If not, why? If so, how might it be fixed?”

A closely related question is that of restitution: should a hacker be obligated to pay costs that clearly are part of normal security procedures? Sometimes hackers are asked to repay system owners for the costs of basic retroactive patch installation.

A brief argument in favor of the CFAA approach is that computer crimes often have unforeseeable effects, and so a very broad proscription is in order.

A student nurse on placement in the hospital developed a good communication relationship with the patient and during a placement shift, the patient had an episode of distress situation where he was very verbal , abusive and physical. The student used a good communication skill to calm the patient down and engaged in a caring and conversation discussion , the patient narrated his health ordeal and how his mental distress which started from his failed marriage led to a spiralled mental breakdown. He neglected doctors advices and failed to take his medications, depression and excessive thinking contributed to a severe hypertensive condition that caused him the sudden stroke.

YOU MUST USE READING SELECTIONS FROM THE TEXTBOOK (The Romantic Period or the Victorian Age). IF YOU DON’T HAVE THE TEXTBOOK, PLEASE CONSULT THE TABLE OF CONTENTS
Write an essay of at least 750 words (including quotations from the poems and prose selections that you use as support) on ONE of the general topics below.  You must discuss at least three reading selections for the topic you choose.
If you use secondary sources in your essay (even those I have provided for you), be sure to cite them, using MLA format. Even if you don’t quote directly, you must cite secondary sources in the paper itself. You will also need to include a works cited list.
Quotations from the textbook require only a page number. Do not repeat the author’s name in parentheses. Just put the author’s name in a sentence in your discussion.
You should choose different poems or prose selections (unless the topic states otherwise) than those you used in your reading responses.
The three examples should be by different authors.
Some of the topics focus on Victorian authors, though for others, you may wish to include writers from the Romantic age.
The paper should be in essay form with an introduction, thesis statement, body paragraphs with transitions, and a conclusion, not a collection of reading responses with sub-headings.
You must use quotations from the reading selections as support for your general ideas. Your examples must show that you have read the literature that you are discussing, not just the author’s biography or an online summary.
A brief overview isn’t adequate. Again, you must show that you read the selection (poem or prose selection) carefully, and you must show how the body paragraphs support your thesis.
You should not choose long poems or plays, since it would be difficult to discuss these thoroughly in a short paper. (You will have an opportunity to write about them in the research paper.)
You will find the Victorian Web very useful, but be sure to cite it if you use information from it.
It’s acceptable to use “I” in the paper, but you should avoid using “I think” too often. Use “I” only when expressing your personal view.
Use present tense when writing about literature.

Here are the general topics. As indicated above, you should choose one of these to write about.

Your examples may include both Victorians and Romantics. Since there are so many poems about nature by a variety of poets, I’m not including a list, but you may send me a message if you need help.

esophageal bleeding

Chief Complaint: 62-year-old man with esophageal bleeding
History: Vincent Miller, a 62-year-old accountant, has had a “drinking problem” throughout most of his adult life. He drinks about a half-case of beer each day. He has lost several jobs over the years for drinking at the workplace or showing up for work drunk. He lost his driver’s license for drunk-driving, and his drinking has placed a considerable strain on his marriage. He has tried several self-help programs as well as Alcoholic’s Anonymous, all with little success. He has been hospitalized on several occasions over the years. Vincent has a severe tremor in his hands (probably a result of excessive alcohol intake), which makes it very difficult for him to use a spoon, fork, and knife to eat. It’s your first day on the job as an occupational therapist, and you are consulted by his physician to see if there is any way to help Vincent use eating utensils. Not knowing anything about him, you open up his past medical records, which, incidentally, are quite thick.

First Hospitalization:
You note that Vincent was hospitalized at age 32 with a complaint of vomiting up blood after a drinking binge that lasted seven days and was marked by excessive and repeated vomiting episodes. The vomitus was bright red.

The hospital chart lists a diagnosis of “Upper GI bleed” due to a Mallory-Weiss tear. You look up “Mallory-Weiss tear” in an internal medicine textbook and see that it is defined as “a longitudinal tear in the mucosa at the gastroesophageal junction — i.e. in the area of the lower esophageal sphincter — caused by repeated vomiting.”

Questions:
1)Why was the blood bright red, rather than the color of “coffee grounds”?

2) Based upon your knowledge of the vomiting reflex, why might severe vomiting tear the mucosa?

Second Hospitalization
At age 36, Vincent was hospitalized again, this time with complaints of abdominal pain in the upper epigastric region (i.e. just below the xiphoid process of the sternum) and “coffee-grounds” emesis. He also complained of “heartburn” (a burning sensation in the area of the sternum) which was partially relieved with antacids. A diagnosis of “upper GI bleed due to gastritis and reflux esophagitis” is noted in the chart.

Questions:
1)What is causing the pain in the upper epigastric region ? What barrier(s) normally protect the stomach lining from its own acid?
